As malls adapt to evolving consumer needs, these large vacant spaces present exciting opportunities for innovative transformations. Together, we’ll discuss what new experiential tenants are looking for when determine where to build, and what property owners are doing to attract new tenants and provide new engagement with local communities. After a panel discussion, we will ideate together creative approaches to repurpose sites, addressing the technical challenges of redesign while considering overall tenant mixes, how to make these project types financially viable, and debating what the right tenant mixes are to help grow the next generation of retail communities. In this session, attendees will delve into the realm of legal contract negotiations and the common issues each party at the table faces. Our legal expert will facilitate an exercise, featuring insight from retailer/owner, GC and A/E experts on legal negotiations. We will look at several real-world examples and the common ambiguities in language, responsibilities, liabilities and indemnities that result in delayed negotiations. We will focus on common pitfalls to look for when dealing with various parties, and potential common ground concessions or alternatives to bring everyone together early in the process, avoiding time lost in legal review. Too often our relationships are damaged early in the engagement by the lack of good-faith negotiation, and attendees will leave with takeaway examples of potential compromises to expedite the process, keep everyone positive, and protected.
